Preamble

CodeFryDev respects intellectual property rights and responds to notices of alleged copyright infringement in a manner consistent with applicable law, including the Information Technology Act, 2000 (India) and, where applicable, the U.S. Digital Millennium Copyright Act (DMCA)—following practices analogous to those articulated in GitHub’s DMCA policy .


Submitting a Takedown Notice

A written notice should be transmitted to codefrydev@gmail.com with the subject line “Copyright Notice”, incorporating the following elements:

  1. Identification of the copyrighted work alleged to have been infringed;
  2. Identification of the infringing material and its precise location (URL, repository path, product designation);
  3. Contact particulars of the notifying party (name, address, electronic mail, telephone);
  4. A statement, executed in good faith, that the contested use is not authorised by the copyright proprietor, its agent, or applicable law;
  5. A declaration, under penalty of perjury where applicable, affirming the accuracy of the information supplied and the notifier’s authority to act on behalf of the rights holder; and
  6. The physical or electronic signature of the authorised representative.

Counter-Notification Procedure

Where a party believes content was removed in error or through misidentification, a counter-notification may be submitted comprising:

  1. identification of the removed material and its former location;
  2. a statement, under penalty of perjury, that removal was effected through mistake or misidentification;
  3. consent to the jurisdiction of competent courts in India (and U.S. federal court where applicable); and
  4. the submitter’s name, address, electronic mail, and signature.

Repeat Infringers

Accounts or users adjudged to be repeat infringers may have access privileges terminated in accordance with the General Terms .


Open Source & MIT Projects

Forks of MIT-licenced CodeFryDev projects must retain copyright notices as mandated by the licence. Removal of requisite attribution may constitute copyright infringement. See Article 29 .


Misrepresentations and Liability

Knowingly submitting false or materially misleading infringement claims may expose the submitter to liability for damages, including costs and legal fees, under applicable law.
